These Terms and Conditions apply when you access autochimp.com.au (the Website) or buy products from us. By using the Website or placing an order, you agree to these terms. If you do not agree, please do not use the Website.

2. Eligibility and accounts
You must have legal capacity to enter into a contract to place an order. If you create an account, you must provide accurate and current information and keep your login details secure. You are responsible for activity carried out through your account unless caused by our act or omission. Please contact us promptly if you suspect unauthorised access.
3. Website use
You may use the Website for lawful personal or business shopping purposes. You must not interfere with the Website, introduce malicious code, attempt unauthorised access, circumvent security controls, misuse customer or business data, or copy substantial Website content for an unauthorised commercial purpose.
We permit ordinary indexing by authorised search engines and AI services where consistent with our published technical controls. This permission does not authorise scraping that overloads the Website, bypasses access controls or infringes our or another person’s rights.
4. Product information and compatibility
We take reasonable care to describe and display products accurately. Colours, packaging and minor product details may vary from what appears on screen. Vehicle compatibility depends on the specific make, model, year, factory equipment and installation configuration. Before ordering, you should review the product description and compatibility information or contact us if you are unsure.
Products must be installed and used in accordance with their instructions and all applicable laws. Professional installation may be appropriate for some products. Nothing in this section excludes any right or remedy that cannot lawfully be excluded.
5. Orders and availability
When you place an order, Shopify will send an electronic acknowledgement. We may contact you if we need to confirm compatibility, payment, delivery information or other order details. An order is accepted when we confirm it after payment authorisation or dispatch the goods, whichever occurs first.
We may decline or cancel an order before dispatch where a product is unavailable, information or pricing contains a genuine error, payment is not authorised, fraud is reasonably suspected, or we cannot lawfully or reasonably deliver to the address supplied. If we cancel an order after taking payment, we will refund the amount paid for the cancelled items and any applicable shipping charge.
6. Prices, GST and payment
Prices displayed for Australian customers are in Australian dollars and include GST where applicable, unless clearly stated otherwise. International prices may be displayed in a local currency through Shopify Markets. Exchange rates and card-provider fees may apply.
International customers are responsible for import duties, taxes, customs charges and brokerage fees imposed by the destination country unless checkout expressly states that they are included. Payment methods are those shown at checkout. You confirm that you are authorised to use the selected payment method.
7. Shipping and delivery
We currently focus on Australia and offer delivery to selected international destinations. The destinations, services, estimated timeframes and charges available for an order are shown at checkout and explained in our Shipping Policy. We currently use FedEx for international shipping.
Delivery dates are estimates unless we expressly agree otherwise. Delays may occur because of carriers, customs, weather, supply issues or events outside our reasonable control. We will provide tracking where available and will contact you if we become aware that we cannot supply within the stated or a reasonable timeframe. If we cannot fulfil your order, we will offer an appropriate solution, which may include a replacement, revised timeframe or refund.
You must provide a complete and accurate delivery address and ensure someone can receive the parcel where required. Additional reasonable costs caused by an incorrect address or repeated failed delivery may be charged to you where permitted by law. Responsibility for loss or damage does not pass to you merely because we hand the goods to our carrier.
8. Returns, refunds and consumer guarantees
Our Returns, Refunds and Exchanges Policy explains our return process, including change-of-mind returns and international returns.
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You may be entitled to a repair, replacement, refund or compensation if a product fails to meet an applicable consumer guarantee. Change-of-mind conditions and any requirement for an international customer to pay return shipping do not limit rights that cannot lawfully be excluded. Where a return is required because the goods breach an applicable consumer guarantee, we will meet our obligations under the law, including reasonable return costs where required.
9. Warranties and installation issues
Any manufacturer or express warranty is in addition to your rights under the Australian Consumer Law. A warranty may not cover damage caused by misuse, unauthorised modification, incorrect installation, accident, neglect or use contrary to instructions, but only to the extent permitted by law and to the extent that the issue was caused by that conduct.
If you believe a product is faulty or unsuitable, stop using it where continued use may cause damage or create a safety risk and contact us with your order details and a description of the issue.
10. Intellectual property
The Website and its original text, images, logos, software and other content are owned by or licensed to AutoChimp and are protected by intellectual property laws. You may view and make reasonable copies for personal shopping, product installation or record-keeping. You must not reproduce, modify, distribute or commercially exploit substantial Website content without permission, except as allowed by law.
11. Reviews and other content you submit
If you submit a review, photo, question or other content, you confirm that you have the right to provide it and that it is not unlawful, misleading, defamatory, infringing or malicious. You retain ownership of your content and grant us a non-exclusive, worldwide, royalty-free licence to host, reproduce, adapt and display it for operating, improving and promoting our Website, products and business. This licence lasts only for so long as reasonably necessary for those purposes, subject to legal and record-keeping requirements.
We may moderate or remove submitted content where reasonably necessary, including content that violates these terms, but we are not required to monitor all content.
12. Third-party services and links
The Website may use or link to third-party services such as Shopify, payment providers, carriers and external websites. Their own terms and privacy practices may apply. We are not responsible for independent third-party content or services, but this does not limit responsibility we have under applicable law for services we arrange as part of your order.
13. Privacy
Our handling of personal information is explained in our Privacy Policy.
14. Liability
Nothing in these terms excludes, restricts or modifies the Australian Consumer Law, any consumer guarantee, or any other right or remedy that cannot lawfully be excluded, restricted or modified.
To the extent permitted by law, we are not responsible for loss or damage that was not caused by our breach, negligence or unlawful conduct, or that was not reasonably foreseeable. We are not responsible for damage caused by your misuse, unauthorised modification or incorrect installation of a product to the extent that your conduct caused the damage. This section does not exclude compensation available for reasonably foreseeable loss or damage resulting from a failure to comply with an applicable consumer guarantee.
15. Suspension and termination
We may suspend or restrict access to the Website where reasonably necessary to protect the Website, users or our business; investigate suspected unlawful or fraudulent activity; carry out maintenance; or comply with law. Ending access does not affect rights and obligations relating to an order already accepted.
16. Changes to these terms
We may update these terms from time to time to reflect changes to our business, the Website or the law. Updated terms will be posted here with a revised date and apply prospectively. Changes will not alter an order already accepted unless you agree or the change is required by law. Your continued use of the Website after an update means the updated terms apply to later use.
17. Governing law and disputes
These terms are governed by the laws of Victoria and the Commonwealth of Australia. The courts of Victoria and courts entitled to hear appeals from them have non-exclusive jurisdiction. If mandatory consumer laws in another place apply to you, nothing in these terms limits those rights.
If a dispute arises, please contact us first so we can try to resolve it promptly. This does not prevent either party from exercising any legal right or contacting a consumer protection body.
18. General
If any part of these terms is unlawful or unenforceable, that part will be read down or severed to the minimum extent necessary and the remaining terms will continue. A delay in exercising a right does not waive that right.
